The open parking spaces are a part of the common area of a real estate project and are free of Floor Space Index according to the Real Estate (Regulation and Development) Act. Therefore, the Maharashtra Real Estate Regulatory Authority (MahaRERA) has strictly issued a notice for the developers. The notification states that the developers are not entitled to sell or allot open parking space to any homebuyer.
The chairman of MahaRERA, Ajoy Mehta conveyed that he has been receiving complaints from homebuyers as parking is being allotted with the discretion of the developers. A notification has been released to clarify the issue. Mr. Mehta also confirmed that there were lesser complaints after the notice.
The notification stated that the developers would be required to specify the garage, open and covered parking space in the real estate projects according to the approved/sanctioned plans and tag it to the allotted apartment.
Consumer right activist Shrikant Joshi believes that the issued notification will not just keep a check on the developers, it will benefit the home buyers too.
Chairman of the Maharashtra Societies Welfare Association added that open parking space cannot be sold in accordance with the earlier judgements of SC, HC and MOFA act. Therefore, during conveyance, the builder has to hand over the open car parking to the society.
